The text of the law of December 19, 2008 requires that all human body material used in research with the agreement of the ethics committee be traced by a biobank notified to the FAMHP.

The notion of traceability is the ability to locate and identify HBM at every stage of the process, from obtaining it, through processing, control and storage, to distribution for use or destruction.

A biobank can be notified by the FAMHP on condition that :

  • obtaining a positive opinion from the Ethics Committee on the biobank's objectives and activities
  • submit an activity report to the Ethics Committee every 2 years
  • a record is kept of the nature of the HBM, its origin and destination
  • establish a written agreement between the biobank operator and the person or institution to which the HBM is made available
  • the manager of the biobank's human body material must be a physician
